The are additional opportunities to increase the potential of small hydropower as a result of using the waste potential return water process (drinking water supply, drainage, return waters of mining and processing plants, treatment facilities of cities and enterprises. In this case power generation is carried out in the absence of negative effects on the flora and fauna, as well as in the return water no fish, river animals, rare birds. There is no need to build a dam, new reservoir, or not need to flood the surrounding area. The construction of small hydropower plants on the commissioned water supply and sewerage facilities contributes to the modernization of the existing facility (repair or replacement of individual elements) and increase its reliability as a result of the installation of a modern automated control and monitoring system. But in most cases, except for drinking water supply, return waters contain significant amounts of impurities and chemicals, which significantly increases the unit cost of the equipment. Operation of equipment in an aggressive environment reduces the profitability of these projects. Therefore, obtaining of "green" tariff for generating electricity by such small hydropower plants is almost the only motivation for private investors. However, the current regulations there is no unambiguous interpretation of the terms of the establishment of "green" tariff for hydropower plants on the return water. The article defines the legal aspects for the establishment of "green" tariff for electricity generated using hydropower potential return water of technological processes. Is given a brief description of the implemented pilot project of a small hydropower plant on the wastewater of urban treatment facilities in Ukraine, for which a "green" tariff for electricity is set.
